These Terms of Service (“Terms”) govern your use of a11ops' alert infrastructure service. By using our service, you agree to be bound by these Terms.

1. Agreement to Terms

By accessing or using a11ops, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you may not access our service.

If you are using a11ops on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

a11ops provides a cloud-based alert infrastructure service that enables you to:

  • Send and manage critical alerts
  • Integrate with monitoring and observability tools
  • Configure alert routing and notifications
  • Collaborate with team members on incident response

We reserve the right to modify, suspend, or discontinue any part of our service at any time.

3. Account Terms

Account Creation

  • You must provide accurate and complete information
  • You must be at least 16 years old
  • You are responsible for maintaining account security
  • You must notify us immediately of any unauthorized access

Account Responsibilities

  • You are responsible for all activity under your account
  • You must not share your account credentials
  • You must comply with all applicable laws and regulations
  • You must not use the service for any illegal purposes

4. Acceptable Use Policy

You agree not to use a11ops to:

  • Violate any laws or regulations
  • Transmit malicious code or interfere with the service
  • Attempt to gain unauthorized access to any systems
  • Harass, abuse, or harm another person or entity
  • Send spam or unsolicited communications
  • Infringe on intellectual property rights
  • Exceed rate limits or use the service in a way that degrades performance for others

Violation of this policy may result in immediate termination of your account.

5. Payment Terms

Billing

  • Paid plans are billed monthly or annually in advance
  • Additional usage beyond plan limits is billed at the end of each period
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice

Payment Methods

We accept major credit cards and ACH transfers for Enterprise customers. You authorize us to:

  • Charge your payment method for all fees
  • Store your payment information securely
  • Update your payment information as provided by your bank

6. Service Level Agreement

For paid plans, we commit to:

  • 99.99% uptime SLA for Team and Enterprise plans
  • 99.9% uptime SLA for Starter plan
  • Service credits for downtime exceeding SLA thresholds
  • 24/7 monitoring and incident response
  • Multi-region failover capabilities

7. Intellectual Property

Our Property

a11ops and its original content, features, and functionality are owned by a11ops and are protected by international copyright, trademark, and other intellectual property laws.

Your Content

You retain all rights to the content you submit to a11ops. By using our service, you grant us:

  • A license to use, store, and process your content to provide the service
  • The right to display aggregated, anonymized data for analytics
  • Permission to use your company name and logo as a reference customer (with your consent)

8. Warranties and Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF INFORMATION

We do not warrant that the service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, a11ops SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • SERVICE INTERRUPTIONS OR LOSS OF BUSINESS

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless a11ops, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or data

11. Termination

Either party may terminate these Terms:

  • Free accounts: At any time without notice
  • Paid accounts: With 30 days written notice
  • For cause: Immediately upon material breach

Upon termination, your right to use the service ceases immediately. We will retain and use your information as necessary to comply with legal obligations and resolve disputes.

12. Governing Law and Disputes

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through:

  1. Good faith negotiation
  2. Mediation in Delaware
  3. Binding arbitration under AAA rules

You waive any right to a jury trial or to participate in a class action.

13. Changes to Terms

We may revise these Terms at any time. We will notify you of material changes via email or through the service. Your continued use after changes take effect constitutes acceptance of the revised Terms.
